What you will learn

This micro-credential is important for tourism students and also other students from other programmes that have the topic of the law of negligence in their study package because it exposes one very relevant aspect of the day-to-day activity namely the necessity of not being negligent in their job. Students must be revealed of their duty to act carefully and the impact of not doing so from the perspective of the organisation they attach to and the bearing it has on them personally. This micro-credential will elucidate the elements to establish negligence so that one will understand that not in all situations a case can be brought to the court on this ground. This topic will generally introduce students to the law of tort where negligence is one of situations which can arise under Tort.

-situations where negligence can arise in tourism
-general negligent cases

This topic describes the first element of negligence which is the duty of care where the claimant must prove that the defendant has a duty of care towards the claimant (plaintiff). The topic covers:

- definition
- neighbourhood principle
- Donoghue v Stevenson
- Haley v London Electricity Board
- Kris Angsana Sdn Bhd v Eu Sim Chuan

After proving the first element, this topic will explain the second element under negligence which is the breach of duty of care which covers the following sub-topics:

- definition
- reasonable man's test
- examples of situations
- factors to establish breach of duty of care
- cases for each of the factor

This topic explains the link between breach of duty of care with the damages that occur to the plaintiff and will include the following sub-topics:

This topic concerns the liability of a person because of the action or omission of another person.
